JUSTICE HARISH KUMAR ORAL ORDER 03-11-2022 Heard Mr. Samshad Alam, learned counsel appearing on behalf of the petitioners submits that he has no instruction with regard to the present factual position and despite his best effort, he could not be able to contact his clients, as such he seeks permission to withdraw the present application. On the other hand, learned counsel for the State fairly submitted that in response to the present writ application, a counter affidavit has been filed on behalf of respondent no.3,

Patna High Court CWJC No.257 of 2021(5) dt.03-11-2022 2/2 stating the present factual position and so far as the grievance of the petitioner no.1 is concerned, the same has been redressed. However, on account of non-submission of requisite service record/papers, necessary payment could not be made to the petitioner no.2. He further submits that the petitioner no.2 may be directed to furnish necessary documents.

In view of the submissions made on behalf of the parties and considering the fact that the learned counsel for the petitioner has no instruction with regard to the present factual position and he seeks permission to withdraw the present application, this court left with no option but to allow the learned counsel for the petitioners to withdraw the present application.

Accordingly, the present writ application stands dismissed as withdrawn.
