The petitioner apprehends his arrest in connection with Rupaspur P.S. Case No.270 of 2022, registered for the offences punishable under Sections 341, 323 and 354 of the Indian Penal Code.

The petitioner is said to have taken Rs.60,000/- from the husband of the informant and did not return the same. When the informant demanded the money from the petitioner, the petitioner assaulted her.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got three criminal antecedents as stated in paragraph-3 of the bail application. It is further submitted that the petitioner has filed a

Patna High Court CR. MISC. No.38097 of 2022(3) dt.03-11-2022 2/2 supplementary affidavit stating therein that he has already paid Rs.60,000/- to the informant.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the statement of the petitioner in the supplementary affidavit that he has already paid Rs.60,000/- to the informant, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Danapur, Patna in connection with Rupaspur P.S. Case No.270 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
