JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 This application, for grant of anticipatory bail, arises out of Sangrampur P.S. Case No. 55 of 2015, disclosing offences under Sections 366(A)/34 of the Indian Penal Code. Allegation against the petitioner and others is of kidnapping the minor daughter of the informant. Submission of learned counsel for the petitioner is that he happens to be brother of co-accused Prem Pandey against whom there is allegation that he eloped with the daughter of the informant for the purpose of marriage and the said co-accused has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 21.06.2019 passed in Cr. Misc. No. 37716 of 2019 and further in her statement under Section 164 Cr.P.C. the girl has

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -14, East Champaran, Motihari, in connection with Sangrampur P.S. Case No. 55 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
