The petitioner is languishing in custody since 29.10.2018 in a case registered for the offences punishable under Sections 302/34 of the IPC and Section 27 of the Arms Act. The prosecution case is that the father of the informant was killed while returning from the market, leading to registration of FIR against unknown persons. The name of the petitioner sprang up in the third statement of the informant, wherein he has stated that he heard about the involvement of the petitioner in the alleged offence.

It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been roped in the present case. A statement has been made in paragraph no.3

Learned APP submits that the name of the petitioner sprang up during investigation.

Considering the fact that no specific evidence has been collected against the petitioner during investigation and the investigation being already concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-V, Begusarai in connection with Bakhri P.S. Case No. 106 of 2017.
