JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 448, 341, 323, 324, 506, 427 and 380 of the Indian Penal Code.

The accusation against the petitioners and others is to have entering into the house of the informant, committing theft and assaulting the informant and his family members. It is submitted by learned counsel for the petitioners that a statement has been made in para 9 of the petition that the

Patna High Court Cr.Misc. No.5360 of 2015 (2) dt.10-02-2015 2/2 informant has not received any injury. Though, specific accusation of assault with farsa is against Thakko Yadav (non-petitioner) causing injury to five years old grand-daughter of the informant namely Ansu Kumari and the accusation of committing theft in the house of the informant is omnibus and general. Considering the fact that accusation of assault is not specific against these petitioners, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipur, Darbhanga in connection with Bahera (Ali Nagar) P.S. Case No. 361 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
