JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 376 of the Indian Penal Code.

The accusation is of establishing forceful physical relationship and thereafter continuing same for more than a year and when the victim became pregnant, demand of dowry was made.

It is submitted by learned counsel for the petitioner that both sides are now agreed to perform marriage. A statement to that effect has been made in para 10 of the petition which reads as follows:- "That on perusal of the entire facts mentioned above it clears that the petitioner as well as the alleged victim girl are major and out of their own will they

No.6385 of 2015 (2) dt.18-02-2015 2/2 developed physical relationship but due to some misunderstanding the present case was lodged by the informant who is the uncle of the victim girl. It is pertinent to mention here that now good sense has prevailed between the parties and both are going to solemnized marriage."

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Sitamarhi P.S. Case No. 631 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioner will be accepted by learned court below on filing affidavit by the victim that she has reconciled the issue.
