Petitioners apprehend their arrest in connection with Bhorey P. S. case no. 28/2014 registered under section 366A/34 of the IPC. The statement of victim has been recorded under section 164 Cr.P.C in which she, nowhere, stated about role of the petitioners in the alleged crime rather she stated that she has solemnized her marriage with co-accused Mukesh by her own sweet will and victim was found major at the time of recording her statement under section 164 Cr.P.C.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let

Patna High Court Cr.Misc. No.4803 of 2015 (2) dt.05-02-2015 the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri J. Kumar, Judicial Magistrate, Ist Class, Gopalganj/concerned court in Bhorey P.
