2 The petitioner has preferred this application for grant of regular bail in connection with Pranpur PS Case No 258 of 2022 dated 30.11.2022 registered for the offence punishable under Sections 394, 397 of the IPC and Sections 3, 4 of the Explosive Substances Act.

3 As per the prosecution case, 8-10 unknown miscreants holding weapons entered the house of the informant and took away golden chain, silver jewellery, Rs 30,000/- in cash, voter I/card, Aadhar Card and mobile documents and also assaulted on the head of the informant with iron rod causing inujury.

Patna High Court CR. MISC. No.41854 of 2023(2) dt.24-07-2023 2/2 4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner bears clean antecedent, as stated in paragraph 3 of the bail petition. It is further submitted that the co-accused Ajahar Ali @ Mohammad Ajhar Ali has already been granted bail by this Bench vide order dated 12.07.2023 passed in Cr Misc No 39583 of 2023. The petitioner is in custody in this case since 07.01.2023.

5 Learned APP has vehemently opposed the bail petition of the petitioner.

6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of ACJM I, Katihar in Pranpur PS Case No 258 of 2022 dated 30.11.2022. 7 This application stands allowed.
