In this application for anticipatory bail the petitioner apprehends his arrest for the offence punishable under sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 353, 332, 333, 152, 109, 120 (B) and 427 of the I.P.C.
Allegedly, when the informant being police officer along with police personnel went to execute the process under section 83 Cr.P.C. against Chandan Ram then the villagers including the petitioner started pelting stones on the police personnel.
Submission is that the police demolished the house of some of the villagers when the alleged process was executed
Patna High Court Cr.Misc. No.30756 of 2014 (3) dt.22-01-2015 2/2 against the property of Chandan Ram, but others was being harassed and then protest was made and in this case nine persons have been allowed pre-arrest bail by another Bench of this Court vide order dated 18.03.2013 in Cr. Misc. No. 6849 of 2013. The learned A.P.P. is not in a position to distinguish the case of the petitioner from those co-accused. In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Motihari, East Champaran in Turkaulia P.S. Case No. 488 of 2012, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
