JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner, learned counsel for the Informant and learned counsel for the State. The petitioners are apprehending their arrest in connection with Parsa Bazar P.S. Case No. 154 of 2015 for the offences instituted under Sections 457 and 380 of the Indian Penal Code.

As per prosecution case, the accused persons have stolen 2 Almirahs, 2 boxes, 2 drams etc. in the night by breaking the lock of the house of the informant. It is further alleged that the golden chain, golden earrings, golden ring, 20 silver coins etc, were kept in the aforesaid almirah.

It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. Prior to the institution of the present case, one more case was instituted

Patna High Court Cr.Misc. No.11305 of 2016 (2) dt.25-04-2016 by the informant bearing Parsa Bazar P.S.Case No.147 of 2014 which was in respect to the abduction of the daughter of the informant. The daughter of the informant was examined under Section 164 Cr.P.C. in the said case where she has admitted that she was having love affairs with the petitioner no.1 and she wants to reside with him. This is the second attempt on behalf of the informant where he has falsely implicated the petitioners because of the aforesaid reasons.

On behalf of the State and the counsel for the Informant, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Parsa Bazar P.S. Case No. 154 of 2015 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
