JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-06-2016 Heard Sri Bikram Deo Singh, learned counsel for the petitioner and the learned APP for the State. The petitioner apprehends his arrest in Ramgarh P.S. Case No. 87 of 2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Sections 25(1-b)a/26, 25 of the Arms Act added later on. The petitioner is own brother of the deceased. The FIR is against unknown. During the course of investigation, suspicion is raised that the petitioner had enmity with his brother for partition and on account of such he killed his own brother. It is submitted that save and except suspicion there is no material against the petitioner. But it appears that the petitioner has already been declared absconder.
Patna High Court Cr.Misc. No.11443 of 2016 (5) dt.23-06-2016 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order.
