The petitioner seeks bail in a case registered for the offences punishable under Sections 394 and 307 of the Indian Penal Code and under Section 27 of the Arms Act. The learned counsel for the petitioner submits that, initially, the bail application of the petitioner was rejected by order dated 06.01.2023 in Criminal Miscellaneous No. 20801 of 2022, it is next submitted that petitioner has remained in custody since 08.12.2021 and his name in the case transpired based on the confessional statement of Ramesh Kumar, it is next submitted that Ramesh Kumar has been granted the privilege of regular bail by a learned Co-ordinate Bench of this Court by
Patna High Court CR. MISC. No.40275 of 2023(2) dt.05-07-2023 2/2 order dated 23.02.2023 in Criminal Miscellaneous No. 66809 of 2022.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the submission made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Patna City Chowk P.S. Case No. 489 of 2021.
One of the bailors of the petitioner shall be his father namely Vinod Prasad @ Binod Prasd.
