2 At the outset, learned senior counsel for the petitioners has submitted that petitioner No 3 Kavindra Yadav, during the pendency of this application, has been arrested, as such the present application has become infructuous. He, therefore, seeks permission to withdraw this application as far as petitioner No 3 Kavindra Yadav is concerned.

3 Permission accorded.

4 This application is dismissed as infructuous as far as petitioner No 3 Kavindra Yadav is concerned.

No.36360 of 2026(3) dt.22-07-2026 2/3 5 This application has been filed on behalf of the petitioners for grant of anticipatory bail, who are apprehending their arrest in connection with Asthawan PS Case No 95 of 2026 dated 02.04.2026 registered for the offence punishable under Sections 191 (2), 190, 126 (2), 329 (3), 109 (1), 351 (2) of the BNS and Section 27 of the Arms Act.

6 The allegation in the FIR is that the petitioners indiscriminately fired at the informant.

7 The learned senior counsel for the petitioners submits that although allegation of indiscriminate firing is there in the FIR but no body has sustained any injury and he has further submitted that even in the FIR, motive, for what firing has been made, is not mentioned. As such, offence under Section 109 of the BNS is not made out. He has further submitted that wife of petitioner No 2 has lodged one FIR against the informant and others and this case is nothing but a case to put pressure on the petitioners' side to compromise the case lodged by the wife of petitioner No 2.

8 The learned counsel for the State vehemently opposed the prayer for bail.

9 Having considered the rival submissions and the fact that there is no injury as well as the fact that earlier one FIR

No.36360 of 2026(3) dt.22-07-2026 3/3 has been lodged by the petitioners' side on the informant's side, I am inclined to grant anticipatory bail to the petitioners. 10 Let petitioner No 1 Pintu Yadav and petitioner No 2 Sanjay Yadav above named, in the event of their arrest/surrender within a period of four weeks from today, be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda (Biharsharif) in Asthawan PS Case No 95 of 2026 dated 02.04.2026 subject to all conditions as laid down under Section 482 (2) of the BNSS.
