JUSTICE BIRENDRA KUMAR ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and learned counsel for the Vigilance Department.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467/468469/471/409/420 of the Indian Penal Code. Allegation against the petitioner is that she got job of a teacher by producing forged certificate. By order, dated 21.04.2017, the petitioner was directed to refund the remuneration, which she has received as teacher. The petitioner has produced bank draft of Rs.25,000/- and odd, which she has received and refunded. The petitioner is ready to refund further amount, if any, as disclosed from the prosecution side still due with the petitioner.

No.5432 of 2017 (5) dt.19-05-2017 2/2 Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/Successor Court in connection with Kotwali (Adampur) Police Station Case No.416 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
