The petitioner apprehends his arrest in Chakai P.S. Case No. 32 of 2014, registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The father of the deceased made allegation that his daughter was killed by her husband and other in-laws. Learned counsel for the petitioner submits that the petitioner is mother-in-law of the deceased. The daughter of the informant committed suicide only because her husband was not willing to take her Gujarat where he was working. The postmortem report does not show any external or internal injuries. The father-in-law of the deceased was granted anticipatory bail by this Court vide orders passed in Cr. Misc. No. 1894 of 2015.
Patna High Court Cr.Misc. No.5508 of 2015 (2) dt.10-02-2015 Learned APP, however, opposed the prayer for anticipatory bail of the petitioner.
It appears that the petitioner is mother-in-law and the informant has not made any allegation of demand of dowry and torture against the petitioner. The father-in-law has already been enlarged on anticipatory bail.
Considering the facts aforesaid, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, the learned Judicial Magistrate, 1st Class, Jamui in connection with Chakai P.S. Case No. 32 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
