The petitioner apprehends his arrest in Falka (Pothia) P.S. Case No. 274 of 2015 registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code. The mother of the victim alleged that the petitioner kidnapped her minor daughter aged about 16 years for the purpose of marriage.

Learned counsel for the petitioner submits that the victim appeared before Mahila Aayog and she disclosed that no occurrence of kidnapping ever took place, but it appears from perusal of the case diary that almost all the witnesses have stated that it was the petitioner who kidnapped the minor daughter of the informant.
