The petitioner seeks bail in Parbatta (Maraiya) P.S. Case No. 302/2018, instituted for offences under Section(s) 147, 148, 149, 341, 307 and 302 of the Indian Penal Code. Learned counsel for the petitioner has submitted that petitioner has clean antecedent.

Learned counsel for informant had pointed out on 25.07.2019 that petitioner has criminal antecedent, which is not mentioned in para 3 of bail petition. Thereafter, today Supplementary Affidavit has been filed stating therein that one other case is also pending against this petitioner vide Khagaria P.S. Case No. 709/2017, instituted for offence under Sections 8/20(b)(ii) of the NDPS Act. Petitioner is on bail in that case.

Patna High Court CR. MISC. No.37859 of 2019(4) dt.01-08-2019 2/2 This Court finds that there is deliberate attempt on the part of petitioner to suppress this fact in original bail petition. In view of such, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected.

Trial court is directed to expedite the trial. Petitioner may renew prayer for bail after six months if no substantial progress is made in trial.
