The petitioner, who is the elder brother of the deceased, seeks bail in connection with Sono P.S. Case No. 41 of 2021 dated 21.02.2021 instituted for the offence under Sections 304(B) and 34 of the Indian Penal Code. It has been urged on behalf of the petitioner that from the reading of the FIR itself, it would appear that the accusation of demand of dowry and consequent torture is absolutely general and omnibus and not specifically attributed against the petitioner.

In fact, the petitioner, it has been argued he has been residing separately from his brother whose wife has died. The petitioner has always maintained aloofness from the affairs of

Apart from this, it has been submitted that the husband of the deceased viz. the brother of the petitioner is in custody.

The petitioner is in custody since 22.02.2021. Considering the afore-noted facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jamui in connection with Sono P.S. Case No. 41 of 2021.
