Petitioner apprehends arrest in connection with Kesariya P.S. Case No. 154 of 2021 registered for the offences under Sections 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case due to dirty village politics. As a matter of fact the the deceased died due to chronic lung disease as is evident from the Postmortem Report attached at Annexure 2. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the

Patna High Court CR. MISC. No.37627 of 2022(5) dt.27-03-2023 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S. Case No. 154 of 2021 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
