The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 32, 36 and 41(i) of Bihar Prohibition and Excise Act and Sections 272, 273, 120B, 420, 467, 468, 471 of the I.P.C.

8812.26 liters of foreign liquor has been recovered from a truck.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the said truck, but he has been made accused only on suspicion. Nothing has been recovered from his conscious possession. Petitioner has got clean antecedent.

Considering the nature of allegation and clean

Patna High Court CR. MISC. No.38150 of 2022(2) dt.23-09-2022 2/2 antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Motihari, East Champaran in connection with Madhuban P.S. Case No. 211 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
