ABHISHEK REDDY ORAL ORDER 15-11-2025 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of admission with the consent of both the parties.

2. Having regard to the fact that petitioner has only challenged the notice dated 04.04.2025 issued under Section 7 of the Bihar Public Land Encroachment Act, 1956 in Encroachment Case No. 11/2023-24, the present writ petition is disposed of directing the petitioner to file its

Patna High Court CWJC No.10642 of 2025(2) dt.15-11-2025 2/3 explanation/objections to the said notice before the Circle Officer within a period of four weeks from today along with the requisite documents. On such explanation/objections being filed, the Circle Officer shall consider the same strictly in accordance with law and pass a reasoned orders. The authority shall endeavor to dispose of the application/Encroachment Case No. 11 of 2023-24 as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of the copy of the explanation/objections filed by the petitioner.

3. It is needless to mention that before passing any order, the petitioner shall be given an opportunity of hearing. Any order passed shall be communicated to the petitioner.

4. The authority shall endeavour to dispose of the application/Encroachment Case No. 11 of 2023-24 as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of the copy of the explanation/objections filed by the petitioner.

5. Till such time the final orders are passed, the authority is directed not to take any coercive steps against the petitioner. In case the petitioner does not file his explanation/objections within the stipulated period granted by this Court, the authority is free to take necessary action in

6. With the above directions, the present writ petition stands disposed of.
