2. The petitioner seeks bail in connection with Shankarpur P.S. Case No. 231 of 2021 corresponding to G.R. No. 2429 of 2021 dated 25.12.2021, instituted for the offence punishable under Sections 341, 323, 324, 379, 307, 504, 506, 34 of the Indian Penal Code.

3. The prosecution case, in brief, is that on 22.12.2021 at about 8 am petitioner along with five co-accused persons came to the house of the informant and started assaulting the informant and his son with iron rod, lathi and handle of pistol with intention to kill and caused grievous injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he is falsely implicated in this case. It

No.38190 of 2023(2) dt.07-07-2023 2/2 is further submitted that Rudal Yadav and Gopal Yadav assaulted with iron rod and butt of pistol respectively on the head of informant. He further submitted that the injury of the informant is simple in nature. Lastly, it has been submitted that the petitioner is in custody since 10.04.2023 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. I, Madhepura in Shankarpur P.S. Case No. 231 of 2021 corresponding to G.R. No. 2429 of 2021.
