JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Arwal Mahila P.S. Case No. 7 of 2018 registered for the offences punishable under Sections 376, 506 of the Indian Penal Code and Section 4 of POCSO Act. Allegation is that petitioner was apprehended while committing rape with minor deaf and dumb daughter of the informant.

Submission of learned counsel for the petitioner is that the medical report shows that she was pregnant from before and as such the allegation appears to be false. Heard learned APP and learned counsel for the informant, who have opposed the prayer for anticipatory bail stating that allegation is heinous in nature.
