Mr.Sauravh Singh For the Opposite Party/s :

Mr.Sanjay Kumar Sharma ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-06-2026 1.

Heard learned counsel for the petitioners and learned A.P.P. for the State, Sri Sanjay Kumar Sharma. 2.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 64(1), 351(3), 352, 61(2)(b) of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner nos. 1, 5 and 6 are women, and the informant alleges that she went to

Patna High Court CR. MISC. No.36870 of 2026(2) dt.15-06-2026 2/3 Jehanabad on 12-3-2025 to attend a marriage, where she met Rima who took her mobile number, thereafter a call came on her mobile and the caller introduced himself as Bunty and said that the mobile number was given to him by Rima and is working as a photographer in the marriage, further on 28-5-2025, Bunty sent his cousin Suraj to bring her to Jehanabad, who showed the informant some nude edited videos in his mobile, further on 246-2025 she had gone to Hilsa to see her parents-in-law, where Bunty reached based on her mobile location and brought her to Jehanabad and established physical relation in a rented room, again on 1-7-2025 the informant had gone to meet a doctor at Ekangarsarai, where Bunty again came and took her to Jehanabad and forcefully established physical relation and also recorded video, next alleges that petitioners who are related to Bunty were aware of his misdeeds.

4.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that thrust of allegation is against Bunty. It is further submitted that petitioners being related to Bunty have been falsely implicated in the instant case with a view to coerce Bunty into submission.

Patna High Court CR. MISC. No.36870 of 2026(2) dt.15-06-2026 3/3 It is also submitted that it absolutely does not stand to reason that if what has been alleged is a correct fact then why the informant did not institute any FIR when Bunty for the first time had established physical relation, which amply demonstrates that the relationship was consensual and when the same soured, the present false case came to be instituted by the informant implicating the entire family members of Bunty. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jakkanpur P.S. Case No. 1005 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
