The petitioner apprehends arrest in a case registered for the offences punishable under sections 363 and 366A/34 of the Indian Penal Code. The informant alleged that her daughter went to school and when she was at the bus stop, Lakhi Kumar, Gunjan Kumar, Monu Singh and others forcibly kidnapped her. It is submitted that the petitioner is not named in the first information report. The petitioner happened to be the father of Lakhi Kumar Singh. The informant in his subsequent statement stated that the petitioner and his wife having one bag in her hand also came on a motor cycle and eloped their son. It appears that the informant who happens to be the eye witness of

Patna High Court Cr.Misc. No.12776 of 2016 (3) dt.24-06-2016 the occurrence did not disclose this fact in his Fardbeyan but later on named the petitioners.

Considering the fact that the petitioner is father of co-accused Lakhi Kumar Singh, who is alleged to have kidnapped the girl, the above named petitioner, in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 1015 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
