The petitioner being Halka Karamchari is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506 of the Indian Penal Cod and 3(1)(ii)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that on 27.10.2014 at 1.30 P.M. the informant met to the petitioner and enquire about the land which he wanted to purchase then the petitioner annoyed, abused the informant by calling caste name, demanded rupees five thousand and this petitioner snatched silver chain worth rupees eighteen hundred.
It is submitted by learned counsel for the petitioner that at earlier point of time the petitioner filed
Patna High Court Cr.Misc. No.15285 of 2016 (2) dt.13-04-2016 2/2 informatory petition and as a retaliatory measure the present case has been lodged.
It is submitted by Mr. Ambila Bhagat, learned Special P.P. that on conclusion of the investigation charge sheet has been submitted under Sections 323 IPC and 3(1)(ii)(x) of SC/ST (Prevention of Atrocities) Act. Considering the nature of accusation and the filing of the informatory petition at earlier point of time, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Araria SC/ST P.S. Case No. 23 of 2015 pending in the court of learned Subdivisional Judicial Magistrate, Araria. Accordingly, this application is disposed of. (Dinesh Kumar Singh, J) DKS/- U T
