JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2016 Petitioners being parents of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 498A, 379, 354, 341, 323, 504/34 of the Indian Penal Code.
The basic accusation is of torture for nonfulfilment of dowry demand and making assault. It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family including the petitioners. The petitioners claim to be separate from the husband of the informant and after 12 years of marriage the accusation of demand of dowry has been levelled.
Considering the thrust of accusation against the husband of the informant, let the petitioners, above named,
Patna High Court Cr.Misc. No.12028 of 2016 (2) dt.11-03-2016 2/2 in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Samastipur in connection with Samastipur Mahila P.S. Case No. 01 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
