The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No.24 of 2003 registered for the offences punishable under section 147, 148, 341, 323, 353, 283, 379, 324 and 504 of the Indian Penal Code.
The petitioner along with 23 named and 55 unknown accused are charged with assault on the forest officials who were returning after carrying out seizure of illegal felled Shisam woods.
Mr.
Mukesh Kumar Rana, learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the FIR rather it is during the course of investigation that his name has transpired.
Having heard learned counsel for the parties and
Patna High Court Cr.Misc. No.30518 of 2014 (2) dt.14-01-2015 considering the circumstances existing, let the petitioner, namely, Hasim Ansari in the event of his arrest or surrender within four weeks from today be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No.24 of 2003 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure as also subject to the condition that the petitioner shall ensure his representation before the court below on each and every date fixed and if he fails to do so on two consecutive dates without reasonable explanation to the court below, the court concerned shall be at liberty to cancel his bail bonds and to take him into custody.
