The present petition has been filed with a prayer to restore Miscellaneous Appeal No.659 of 2011, which stood dismissed due to non - compliance of peremptory order dated 8.8.2014.

It was submitted by learned counsel for the petitioner that in compliance with the earlier order defects were removed and typed copy of award was also filed but in the covering page instead of giving correct year of the Miscellaneous Appeal incorrectly it was mentioned as Miscellaneous Appeal No. 659 of 2012 instead of M.A. No. 659 of 2011. He submits that even corrected copy is already filed in the present case. In view of the facts and circumstances, the petition

Patna High Court MJC No.441 of 2015 (2) dt.25-03-2015 2/2 stands allowed.

Let Miscellaneous Appeal No. 659 of 2011 be restored to its original file.
