JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 376, 506 and 34 of the I.P.C.

Allegedly, on 20.05.2014 in the night between 12-1 hours the petitioner and co-accused Md. Ashique committed rape with the informant and caused threats not to divulge the same to any one, but the F.I.R. has been lodged on 15.06.2014. Submission is of false implication and that there is inordinate delay in lodging the FIR which cuts the very root of the case and as such the petitioner deserves sympathetic consideration,

Patna High Court Cr.Misc. No.6779 of 2015 (5) dt.21-05-2015 2/2 to which the learned A.P.P. opposes.

Considering the allegation attributed against the petitioner, serious in nature, this Court is not inclined to grant privilege of pre-arrest bail to the petitioner and as such his such prayer stands rejected in connection with Routa P.S. Case No. 42 of 2014 pending in the court of S.D.J.M. Purnea. (Jitendra Mohan Sharma, J) Abhay/- U T
