JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Caste and Schedule Tribes (Prevention of Atrocities) Act. It is alleged that the petitioner persuaded to take insurance policy from G.T.M.S. Company. The informant made payment of fifty two installments of premium to the petitioner but the same was not deposited by the petitioner. Subsequently, when the informant demanded back the premium amount, then the petitioner abused him by calling caste name.

Learned counsel for the petitioner submits that the deposit of premium was made by the informant himself but he

No.8982 of 2015 (2) dt.04-03-2015 2/2 deposited only three premiums as a result the policy lapsed and thereafter the present case has been lodged while the insurance policy was taken by the informant in the year 2003. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Supaul in connection with Supaul SC/ST P.S.Case No. 8 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
