JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This is an application for grant of anticipatory bail in connection with Garkha P. S. Case No. 549 of 2018, disclosing offences under Sections 304B/34 of IPC.
Petitioners happens to be the father-in-law and mother-in-law of the deceased. Allegation of demand of motorcycle and due to non-fulfillment of the said demand, caused the death of the daughter of informant. Submission of the learned counsel for the petitioners is that allegation of demand is against the son of the petitioners and no specific allegation has been attributed against these petitioners. It has also been submitted that earlier petitioner no.1 was also an accused in one case under Section 302/34 of IPC, but in that case, the case was not found true against the
Patna High Court CR. MISC. No.35721 of 2019(4) dt.06-09-2019 2/2 petitioner no.1, which he has mentioned in para 3 of the petition. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner, but admitted the fact that no specific allegation has been attributed against the petitioners. Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-14, Saran at Chapra, in connection with Garkha P. S. Case No. 549 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
