Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 409, 419, 420, 467, 468, 471 of the I.P.C and Sections 7/13(2) of the Prevention of Corruption Act.
It is alleged that informant sold ten cows to Ram Self Help Group, Maldiha and one cow to Sita Self Help Group on credit with assurance that he will be paid the total price of Rs. 2,45,000/- on approval of loan from State Bank of
Patna High Court Cr.Misc. No.7777 of 2015 (2) dt.03-03-2015 2/2 India. However the petitioners did not keep the assurance and the amount was not paid to the informant, though the loan was sanctioned by the State Bank of India and availed by the purchasers.
It is submitted by learned counsel for the petitioners that the cows sold by the informant were returned back as they were not found to be of standard as agreed upon. It is further submitted that keeping in view of the nature of dispute co-accused Birendra Prasad @ Birendra Das has been granted anticipatory bail vide Cr. Misc. No. 46215 of 2013. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-II, Patna in connection with Special Case No. 29 of 2012, arising out of K. Hat P.S. Case No. 550 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
