The petitioner apprehends his arrest in Bind P.S. Case No. 15/2016, registered for the offences punishable under Section 341 and other sections of the Indian Penal Code and Section 3(1)(X) of the S.C./S.T. Act.

The informant alleged that while he was sitting in his house he got information on telephone that his son was being assaulted and the informant went there. The petitioner abused the informant by naming his caste and assaulted him. It is submitted that there is a counter version being Bind P.S. Case No. 14/2016. It appears that of course there is a case and counter case, but the informant has made very specific allegation that the petitioner abused him by naming his caste and also

Patna High Court Cr.Misc. No.11707 of 2016 (4) dt.25-07-2016 2/2 assaulted him.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Vinita/- U
