Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 324 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, petitioner No.1 is alleged to have assaulted the son of informant with brick causing injury on his head whereas petitioner No.2 assaulted wife of the informant with Tangi causing injury on her head. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that present case is counter blast of

Patna High Court CR. MISC. No.38344 of 2022(3) dt.06-12-2022 2/2 Nardiganj PS case No. 68/2022 lodged by petitioner No.2 against the informant and his family members. There is delay of 13 days in lodging the FIR without any explanation. The injuries attributed to these petitioners are simple in nature. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Nawadah in connection with Nardiganj PS case No. 52/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
