The petitioners apprehend arrest in a case registered for the offences punishable under sections 363, 366A/34 of the Indian Penal Code. The informant alleged that the petitioners along with Satya Narain Mandal, Prabhash Mandal and Avinash Kumar alias Chhotu Kumr kidnapped his daughter Chameli @ Anjali Kumari.

It is submitted that the petitioners are brother and mother of Prabhash Mandal. Only suspicion is raised against the petitioners. The victim was recovered and she made her statement under sections 161 and 164 Cr.P.C. The victim

Patna High Court Cr.Misc. No.12788 of 2016 (4) dt.24-06-2016 disclosed the name of Prabhash Mandal and alleged that Prabhash Mandal and his family members kidnapped her and took her to Punjab from where she was recovered. It appears that the victim has not named the petitioners in her statement under section 164 Cr.P.C.

Considering the facts aforesaid, the above named petitioners, in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Supaul in connection with Triveniganj P.S. Case No. 247 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Prabhat Kumar Jha, J) Amin/- U
