Petitioners apprehend their arrest in connection with Maheshkhunt P. S. case no. 142/2011 registered under sections 406, 420, 120B and 506 of the IPC.

According to the prosecution case itself, informant handed over his tractor for repairing in the year 2008 and the present case was lodged in the year 2011. Moreover, it appears from perusal of the content of the first information report that there was dispute between the parties on the point of cost of repairing. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.7294 of 2015 (2) dt.26-02-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Maheshkhunt P. S. case no. 142/2011 subject to condition as laid down under section 438(2) of the Cr.P.C.
