JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 304 of the Indian Penal Code.
It is alleged that the informant's son developed some acute pain in the body when the informant contacted this petitioner who twice injected the son of the informant and subsequently he developed some reaction with the injection and subsequently died. It is submitted by learned counsel for the petitioner that the informant was admitted in Sadar Hospital, Purnea where he was being treated and died there. Neither the report of the Purnea Sadar Hospital which has been brought on record as Annexure-2, nor the postmortem report reflects that the petitioner ever treated the son of informant, moreover postmortem report does not reflect
Patna High Court Cr.Misc. No.6528 of 2015 (2) dt.19-02-2015 2/2 any external injury and viscera has been preserved. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Purnea in connection with K. Nagar P.S. Case No. 545 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
