JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 04-04-2016 This is very unfortunate that an application for grant of arms licence was filed by the petitioner in the year 1995 but no decision could be taken as yet by the authorities. Now, a stand has been taken that the entire record has been destroyed, therefore, no decision can be taken.

Having regards to the facts and circumstances of the case, the petitioner is granted liberty to file a fresh application for grant of firearm licence which will be considered in accordance with law. The licensing authority would be required to take a decision within a period of four months from the date of receipt/ production of a copy of this order. However, since a recommendation has been made in favour of the petitioner by the officer-in-charge, Pandaul

Patna High Court CWJC No.12479 of 2014 dt.04-04-2016 2/2 police station which has been appended by the petitioner as Annexure-15 which is the reply to the counter affidavit, the same may be considered for cutting short the matter, as already, much delay has occurred in this matter, however, this would not disentitle the licensing authority from seeking a fresh report from police in case that is required in the interest of justice.
