The petitioner seeks pre-arrest bail in connection with Ara Town P.S. Case No.11 of 2016 registered under sections 341, 329, 324 and 307 read with 34 of the Indian Penal Code. It is contended that there is a counter case for the same incident vide Ara Town P.S. Case No.12 of 2016 which has been lodged on the basis of the information given by the son of the petitioner which supports the defence of the petitioner that the members of the prosecution party were aggressor. It is further contended that there is land dispute between the parties and the instant case has been lodged by the informant only with an object to take possession of the land of the petitioner forcibly. Learned counsel for the State has opposed the application for grant of anticipatory bail.

Regard being had to the facts and circumstance of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner, namely, Jang Bahadur Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No.11 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
