JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 419,420,467,468,471 and 120B/34 of the Indian Penal Code. It is alleged that petitioner no. 1 Om Prakash Soni executed sale deed with regard to the land of the informant in favour of petitioner nos. 2 to 5 and petitioner no. 6 is identifier of the saledeed.
It is submitted by the learned counsel for the petitioners that petitioner no. 1 executed sale deed with regard to his own land and the informant filed a Jamabandi Cancellation Case No. 52 of
Patna High Court Cr.Misc. No.12543 of 2016 (2) dt.17-03-2016 2/2 2012-13 with a prayer for cancellation of Jamabandi in favour of the petitioners which was dismissed by the Additional Collector, Supaul vide order dated 22.5.2015 on the ground that the question of title is involved which can be decided by the competent Civil Court. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the accusation arising out of civil nature of dispute, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Birpur, Supaul in connection with Raghopur P.S. Case No.196 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
