JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-10-2018 The petitioner is seeking a direction to the District Magistrate, Bagaha (West Champaran) to consider his application as contained in Annexure-3 dated 24.11.2015 seeking grant of sanction against Sri Brinda Lal, L.R.D.C., Bagaha. The grievance of the petitioner is that the District Magistrate, Bagaha is sitting over the said application and is not deciding the same.
Learned counsel for the State is present. However, he has no instruction in the matter.
In the given facts and circumstances of the case, at this stage, without entering into the merit of the contentions of the petitioner, this application is being disposed of with
Patna High Court Cr. WJC No.449 of 2017(2) dt.03-10-2018 2/2 direction to the District Magistrate, Bagaha (West Champaran) to consider the application of the petitioner as contained in Annexure-3 dated 24.11.2015 and dispose of it within a period of 60 days from the date of receipt/production of a copy of this order. He will pass an order independently and on the basis of materials available on the record in accordance with law. This Court has not expressed any opinion on the contention of the petitioner.
