Petitioner apprehends arrest in connection with Complaint Case No. 2104 of 2019, Saran at Chapra registered for the offences under Sections 323 and 498(A) of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that there is general and omnibus allegation against the petitioner. It is also submitted that the petitioner works as assistant driver / khalasi and earns

Patna High Court CR. MISC. No.38491 of 2022(5) dt.28-03-2023 2/2 Rs. 5000/- monthly and is ready to pay Rs. 2500/- for the complainant's maintenance as per para & of the supplementary affidavit. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Sub-Divisional Judicial Magistrate, Saran at Chapra in connection with Complaint Case No. 2104 of 2019, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
