2. The petitioner seeks bail in N.D.P.S. Case No. 4 of 2024 arising out of Begusarai Muffasil P.S. Case No. 23 of 2024 registered for the offence punishable under Sections-8, 20(b)(ii) (B) of N.D.P.S. Act.

3. Allegedly, on the tip off, the informant along with police personnel was checking vehicles on the road and in that course, a tempo came on spot and on search, 1.046 kg. ganja kept under the seat of that tempo was recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is a tempo driver. As per allegation, 1.046 kg.

Patna High Court CR. MISC. No.40568 of 2024(3) dt.19-07-2024 2/2 of Ganja was recovered from the tempo, in question. It has been submitted that the petitioner was not aware with the Ganja. It may belong to the passengers, travelling by that tempo. Further submission is that the petitioner is a person of clean antecedent. The quantity of recovered contraband is in small quantity and the petitioner is in custody since 11-01-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Begusarai in connection with N.D.P.S. Case No. 4 of 2024 arising out of Begusarai Muffasil P.S. Case No. 23 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
