The State Of Bihar .... .... Opposite Party ====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 24-12-2013 Heard learned counsel for the petitioners, the State and the Informant.

Petitioners are apprehending their arrest in connection with a case registered for the offence under Sections 302/34 of the Indian Penal Code. Both of them are named in the First Information Report. Petitioner no.1 is said to have called the deceased whereafter occurrence is said to have taken place in the way.

It is submitted on behalf of the petitioner no.1 that after the occurrence, on account of fear petitioner no.1 disappeared from his house. So far petitioner no.2 is concerned, it is evident that he was available in the house, but did not report about the manner in which deceased suffered death.

Let petitioners above named surrender in the court below within four weeks from the date of receipt/ production of a copy of this order in the court below and thereafter petitioner no.2

Patna High Court Cr.Misc. No.28455 of 2013 (3) dt.24-12-2013 (Naresh Prasad) be admitted to the privilege of bail on furnishing bail bond of ` 5,000/- (` Five thousand only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 28 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

So far petitioner no.1 is concerned, his case should be considered in the light of the statement recorded in paragraphs 21,35,36 of the case diary preferably on the same day. (V.N. Sinha, J) Arjun/-
