1. The present writ petition has been filed seeking the following relief(s):- "1. That this is the writ petition being filed before this Hon'ble High Court on behalf of the aforesaid petitioner for issuance of a writ in the nature of "Certiorari" whereby and whereunder setting aside the notice issued by the Circle Officer Rampur, District- Kaimur(Bhabhua) in encroachment Case No.1/2018-19 whereby the petitioner and others have been directed/ordered to appear on 19.4.2018 in the court of Circle Officer, Rampur, Kaimur(Bhabua) and he has been further directed to

Patna High Court CWJC No.11512 of 2018(3) dt.31-08-2024 2/2 file show cause in relation to the proceeding initiated under Section 3 of Bihar Public Land Encroachment Act 1956 with regard to the lands appertaining to Khata No.138, corresponding to Khesra No.377, admeasuring total area of land 11 decimal falling within Mauza- Majhiyawon, Thana No.776, P.S - Belaon, District - Kaimur (Bhabua). And further prayer of the petitioner to command and direct the state respondents not to disturb the physical possession of the petitioner over the aforesaid land which is residential in nature accommodating the petitioner and his family members for last 70 years and in consequence thereof the petitioner has not erected any permanent structure/building anywhere for the stay of his family members as well as for himself."

2. At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of his aforesaid grievances. Liberty so sought is granted.

3. The writ petition stands disposed off.
