The petitioners are apprehending their arrest in connection with Gopalpur P.S. Case No.81 of 2019 registered for offences punishable under Section 414 of the Indian Penal Code.

As per the FIR, the police intercepted a Sumo Victim vehicle and from there 24 battery of Mobile Tower of Amara Raja Company, 4 battery of Mobile Tower of H.B.L. Company have been recovered. Petitioner no.1 is said to be owner of the vehicle and one person has been arrested at the spot. Submission of the learned counsel for the petitioners is that the FIR itself shows that the petitioners were not present there and they have falsely been implicated and except the confessional statement, there is nothing against them.

No.34833 of 2019(5) dt.01-10-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the petitioner no.1 is owner of the Sumo Victa vehicle and the petitioner no.2 is his friend.. Having heard both sides and in view of the facts and circumstances, as stated above, so far petitioner no.2, above named, is concerned, in the event of arrest or surrender before the learned court below, he may be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge IX, Patna in connection with Gopalpur P.S.Case No.81 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. So far petitioner no.

1, above named, is concerned, he is directed to surrender before the learned court below and pray for regular bail, which will be considered on the basis of the materials available in the case diary and his prayer for bail and if possible to be disposed of on the same day. With the aforesaid direction, this application is disposed of.
