The petitioner apprehends his arrest in a case for the offence punishable under Sections 403, 406, 420, 422, 323 and 379 of the Indian Penal Code.

It is submitted that the petitioner has no criminal antecedent.

This petition stands disposed of with a liberty to the petitioner to move before the learned Chief Judicial Magistrate, Saharsa in Nawhatta P. S. Case No. 137 of 2013 who will pass order in view of the direction given by the Hon'ble Supreme Court in the case of Arnesh Kumar vs.

Patna High Court Cr.Misc. No.32543 of 2014 (2) dt.03-02-2015 2/2 State of Bihar & Anr., reported in 2014(3) PLJR 314 (SC) on the same day.
