JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Khagaria (Muffasil) P.S. Case No. 454 of 2014 registered for the offence under Sections-467, 468, 471, 420, 409 of the Indian Penal Code.

The petitioner happens to be own nephew of the informant and the accusation against the petitioner is that he got issued forged rent receipts and on the basis of forged rent receipts, got sanctioned KCC loan.

Learned counsel for the petitioner submits that as a matter of fact, the order of mutation was not passed in accordance with law and thereafter, rent receipts were issued in favour of the

Patna High Court Cr.Misc. No.11404 of 2015 (2) dt.24-03-2015 2/2 petitioner. It is further contended by him that the informant challenged the order passed in Mutation Appeal No. 39 of 2012 but unfortunately, his appeal was dismissed.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khagaria (Muffasil) P.S. Case No. 454 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Khagaria subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
