The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 290, 341, 34 of the Indian Penal Code and Section 47 (A) of the Bihar Excise Act.

Perused the case record. FIR shows that S.I. Amit Kumar of Mithanpura alongwith police force and other police were on patrolling duty and got secret information that at Khadi Bhandar Chowk behind the market of Gullu Singh 3 persons namely Raj Kumar Paswan, Sunil Paswan and the petitioner used to sell liquor and stored huge amount of illicit foreign liquor stored in wooden Gumti and seeing the police they fled away. On doubt the Gumti was searched and on search 54 pieces

Patna High Court CR. MISC. No.38356 of 2019(3) dt.22-08-2019 2/2 of different brand of foreign liquor and 100 pieces of 200/- ml. country made and pouch were recovered.

There is no recovery from the conscious possession of the petitioner and para 3 of the bail petition to be mentioned that petitioner is not accused in any other criminal case. In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Mithanpura P.S. Case No. 362 of 2014 to the satisfaction of the learned Special Judge Excise, Muzaffarpur, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
